Full Journal pdf1999-04-30 House Journal Page 1109 HB 70 The following, which had been held in second reading to today's calendar (page 1090), was again before the House with Amendment No.1 moved and pending: CS FOR HOUSE BILL NO. 70(RLS) "An Act relating to tests, treatments, surveys, analyses, or evaluations administered in public schools." Representative Kapsner moved and asked unanimous consent to withdraw Amendment No. 1. There being no objection, it was so ordered. Amendment No. 2 was offered by Representatives Dyson and Kapsner: Page 1, lines 1 - 2 (title amendment): Delete all material. 1999-04-30 House Journal Page 1110 HB 70 Insert ""An Act relating to questionnaires or surveys administered in public schools."" Page 1, line 4, through Page 3, line 19: Delete all material and insert: "* Section 1. AS14.03.110 is amended to read: Sec. 14.03.110. Questionnaires and surveys administered in public schools. A school district, principal or other person in charge of a public school, or teacher in a public school may not administer or permit to be administered in a school a questionnaire or survey, whether anonymous or not, that inquires into personal or private family affairs of the student not a matter of public record or subject to public observation unless written permission is obtained from the student's parent or legal guardian. * Sec. 2. AS14.03.110 is amended by adding new subsections to read: (b) For an anonymous questionnaire or survey, written permission required under (a) of this section may be obtained annually and is valid until the commencement of the subsequent school year or until the parent or legal guardian who gave permission submits a written withdrawal of permission to the school principal. (c) If a school administers to a student a questionnaire or survey that is not anonymous, the school shall obtain the written permission required under (a) of this section from the students parent or legal guardian at least two weeks before the questionnaire or survey is administered. The school shall give a parent or guardian an opportunity to review the questionnaire or survey administered in the school and shall give the parent or guardian written notice regarding (1) how the questionnaire or survey will be administered to the student; (2) how the results of the survey or questionnaire will be used; and (3) who will have access to the questionnaire or survey. (d) A student may refuse to participate in a questionnaire or survey administered in a public school. A students parent or legal guardian may refuse to allow the student to participate in a specified questionnaire or survey." 1999-04-30 House Journal Page 1111 HB 70 Representative Dyson moved and asked unanimous consent that Amendment No. 2 be adopted. There being no objection, it was so ordered and the new title appears below: CS FOR HOUSE BILL NO. 70(RLS) am "An Act relating to questionnaires or surveys administered in public schools." Representative Green moved and asked unanimous consent that CSHB 70(RLS) am be considered engrossed, advanced to third reading and placed on final passage. There being no objection, it was so ordered. CSHB 70(RLS) am was read the third time. **The presence of Representative Mulder was noted. The question being: "Shall CSHB 70(RLS) am pass the House?"
